Who it is for

For projects beyond a classic exchange or trading venue

  • platforms for issuing and circulating digital financial assets
  • real-world asset tokenisation projects
  • mining companies and data centres
  • innovative services that do not fit existing statuses
  • issuers planning a token issue
  • banks and fintech companies testing new products
Regulatory questions

What needs deciding

  1. 01

Is the asset a digital financial asset or an unbacked digital asset

  2. 02

Which status the platform, the issuer and the underlying asset custodian need

  3. 03

Which authority regulates circulation of the asset: the NBK or the ARDFM

  4. 04

Does the project fit the NBK special regulatory regime and its criteria

  5. 05

For mining: licence, data centre, mining pool

  6. 06

What disclosure and investor protection requirements apply

Regimes

How the question is answered under each regime

Kazakhstan · national regime

Several separate statuses

  • a digital financial asset platform operator is registered with the NBK
  • circulation of digital financial assets, except stablecoins, is regulated by the ARDFM
  • digital mining is carried out under a licence; mining pools are accredited
  • the NBK has introduced a special regulatory regime for digital asset and payment services; participants are selected on the basis of set criteria and their business plan
Kazakhstan · AIFC / AFSA

AIFC rules

  • issuance and circulation of digital assets in the AIFC are governed by AIFC law
  • issuing fiat stablecoins in the AIFC requires AFSA authorisation
  • a specific token is classified under AFSA rules
Other jurisdictions

Assessed on request

  • tokenisation and issuance regimes differ by country
  • the EU applies the MiCA Regulation
  • foreign law is handled with local counsel

How an activity is classified depends on the actual model: who is the client's counterparty, where assets and keys are held, how settlement works, who the services are for. Information is current as of October 2026 and is confirmed during the project assessment.

FAQ

Frequently asked questions

Describe your project in a few sentences. We will give you a substantive reply: which questions need answering and where to start.

Discuss your project
How does a digital financial asset differ from an unbacked one?

A digital financial asset certifies a claim in respect of an underlying asset and is issued on a DFA platform operator's platform. Assets that do not meet the DFA requirements are treated as unbacked.

What is the special regulatory regime?

It is an NBK regime for testing new products in digital assets and payment services. Participation is possible if the project meets the selection criteria and the regime's objectives.
